The Plaintiff: a 60 year old porter-handyman
This case settled at a mediation hearing for the sum of one million dollars ($1,000,000.00) in compensation for this accident.
The Plaintiff, a 60 year old porter-handyman, claimed that while working at a college campus in Staten Island he was caused to trip and fall down 15 steps when his foot got caught under a raised portion of the rubber capping over the front edge of a stair. Importantly, photos of the stairs taken by campus security just after the accident were claimed to have been lost by the defendant.
Plaintiff’s damages included neck injuries which resulted in surgery involving diskectomies and fusion with a plate and screws at C5-6 and C6-7 as well as a torn left rotator cuff that required arthroscopic surgery. Although the Plaintiff did suffer from arthritis/degenerative orthopedic conditions in his neck and left shoulder prior to the accident we were able to obtain a seven figure settlement for the Plaintiff.
