Box Falls from Shelf Results in Mediation Settlement of $3,000,000
Plaintiff: Employee working on site
Plaintiff’s Attorney: Thomas K. Miller
This case recently settled during a mediation hearing for $3,000,000.
Facts: Our client was struck on the head and neck by a storage box that fell off a shelf in the supply room he was working in. We claimed that the box had been improperly placed by the building owners employees who had been doing renovation work in the supply room. The lower court judge originally dismissed the case but after we made a motion to reconsider the court reversed itself and said there were questions of fact as to if the defendant’s workers were the cause of the accident. Thereafter, the defendant appealed this decision to the Appellate court which unanimously held that the lower court was correct in determining questions of fact existed.
Injuries: Our client suffered herniated discs in the neck and lower back which required two surgeries.
